Terms and conditions for products purchased online
Welcome to the Iceberg shop. Iceberg Interactive BV, a publisher of videogames, provides you access to the Iceberg Shop website (the "website") to sell our products to you subject to the terms and conditions set out on this page.
Please read these terms and conditions carefully before using the Iceberg Shop website. By using the Iceberg Shop website, you signify your agreement to be bound by these terms and conditions.
Terms and Conditions for using the Iceberg Shop:
1. Your Account
If you use the Iceberg Shop, you are responsible for the use of the Products from the Iceberg Shop Website using your username and password. You agree to accept responsibility for all activities that occur under your account or password. You are responsible for protecting and keeping secure your username and password from unauthorized use. You must not disclose your username and password to any other party and you will take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized way.
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account area of the website.
The Iceberg Shop reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.
2. Privacy policy
Iceberg Shop treats all personal information as private and confidential. We do not disclose personal information to third parties except for our service provider hosting our web application. This company works on behalf of Iceberg Shop to provide a product or service to you and will use the information solely for technical purposes.
3. Access to Iceberg Shop
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for maintenance, or the introduction of new facilities or services. This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.
You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Iceberg Interactive without express written consent. You may not use any meta tags or any other "hidden text" utilizing the Iceberg Interactive trademark without the express written consent by us.\
5. Your conduct
You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not us, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.
You must not use the website for any of the following:
- for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
- to cause annoyance, inconvenience or needless anxiety
Iceberg Shop does not sell products to children. We sell children's products for purchase by adults. If you are under 18, you may use the Iceberg Shop only with the involvement of a parent or guardian.
6. Copyright, authors' rights and database rights
All content included on the website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Iceberg Interactive and is protected by international copyright, authors' rights and database right laws. The compilation of all content on this website is the exclusive property of Iceberg Interactive and is protected by Dutch and international copyright and database right laws. All software used on this website is the property of Iceberg Interactive or our software suppliers and is protected by international copyright and author' rights laws.
7. Trademarks
Iceberg Interactive and other marks indicated on our website are trademarks or registered trademarks of Iceberg Interactive in the European Union and/or other jurisdictions. All other trademarks not owned by us that appear on this website are the property of their respective owners.
8. Advertising Material (such as Google Ads)
Content appearing on the Iceberg Shop Website may include advertising and other material submitted by parties other than Iceberg Shop and the Iceberg Shop Website will provide links to other sites operated by advertisers and third parties. It is the responsibility of such advertisers and third parties to ensure that such material and such sites comply with all relevant laws and regulations. (To the full extent permissible by law, Iceberg Shop disclaims all responsibility for any error, omission or inaccuracy in such material or its failure to comply with the relevant laws or regulations.
When you place an Order to purchase a product from Iceberg Shop, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you. That acceptance will be complete at the time we send the E-mail to you.
We only possess rights to certain products in certain territories, which are listed on the Product Page. If you are not a resident of such a territory listed per product, we cannot sell you the product. Please do not order it.
9.1 Shipping
When Iceberg receives your payment, the product will be shipped the same day (depending on availability) Shipping time will vary from four days to six also depending upon availability. Pre-orders are shipped upon the official release date of the product.
10. Returns
Once opened, a Product cannot be returned unless it clearly is incomplete or faulty. You are responsible to ship back the Product to Iceberg Shop yourself at your own expense.
Upon receipt of your returned product we shall check whether the product is damaged, incomplete or faulty and if this is the case your purchase price will be refunded.
11. Pricing and availability
We list availability information for products sold by us on the website on each product information page. You will there find pricing, product code, descriptions and availability
All prices are inclusive of VAT unless stated otherwise.
12. Customs
When ordering goods from the Iceberg Shop for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Iceberg Shop, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
13. Alteration of Service or Amendments to the Terms & Conditions
We reserve the right to make changes to our website, policies, and these Terms & Conditions at any time. You will be subject to the policies and Terms & Conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
14. Force majeure
Iceberg Shop shall not be liable to you under the terms of this contract or otherwise if the our breach of our contractual and/or other obligations to you are due in whole or in part to interruption and delay by reason of matters beyond its control (including but not limited to) acts of God, acts of any government, war, other hostility, civil disorder, the elements, fire, explosion, power failure, equipment failure, industrial or labor dispute and/or inability to obtain essential supplies and the like.
15. Term and Termination
This agreement shall commence on the date that you first log on to the Iceberg Shop Website and shall continue to renew automatically in 12 month intervals until terminated.
You may terminate your subscription in respect of the Products by no less than sixty days written notice prior to the renewal date, however any refund of subscription fees paid is at Iceberg Shop’s discretion.
On expiry or termination of this agreement for whatever reason Iceberg Shop will remove your access to the Iceberg Shop Website immediately.
16. Waiver
If you breach these terms & conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
17. Governing law and jurisdiction
These conditions are governed by and construed in accordance with the laws of the Netherlands and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree, as we do, to submit to the non-exclusive jurisdiction of the courts of the district of Amsterdam.
